At DeutschExam.ai, we want you to be satisfied with our German exam preparation platform. This policy outlines our fair and transparent refund terms, designed to protect both you as a learner and the integrity of our service.

**Our Commitment:** We offer a **14-day "Fair Use" satisfaction guarantee** for eligible German exam preparation subscriptions. If the platform doesn't meet your expectations within the first 14 days and you've used it minimally, you can request a full refund. **FSP AI speaking plans are treated separately** because they unlock high-cost AI speaking sessions and are excluded from voluntary satisfaction refunds once premium access begins.

## 1\. 14-Day Fair Use Guarantee

**This guarantee applies to eligible A1, B1, and B2 German exam preparation subscriptions.** It does not apply to FSP AI speaking plans once premium access begins; see Section 2A below.

We believe in our product, but we understand it may not be right for everyone. Within **14 days** of your initial purchase, you may request a full refund if:

-   You have completed **fewer than 2 exams** (including free mock exams and practice modules)
-   You have used the platform for **less than 45 minutes total** (all activity including free and paid features)
-   You have made **fewer than 20 AI feature requests** (writing feedback, explanations, speaking practice)
-   You have not downloaded any premium content (letter samples, PDFs)

**Why these limits?** These fair-use thresholds prevent misuse (e.g., extensively using the platform and then requesting a refund). The total platform usage limit includes all activity — free exams, practice modules, and AI features. If you've genuinely tried the platform briefly and aren't satisfied, you'll easily qualify for a refund.

## 2A. FSP AI Speaking Plans — Voluntary Refund Exclusion Once Access Begins

**Important FSP Notice:** Fachsprachprüfung (FSP) plans provide access to AI speaking sessions, AI-generated feedback, transcripts, the FSP exam guide, and related digital practice content. Because these features create immediate AI processing costs and can be consumed quickly, **FSP paid plans are not eligible for voluntary satisfaction refunds once premium access begins**.

-   Try the free FSP module before purchasing to confirm that the format fits your needs.
-   If you want a low-cost paid trial, start with the 48-hour FSP pass before choosing a longer plan.
-   Refunds remain available for duplicate payments, incorrect charges, or cases where paid access does not activate and we cannot resolve the issue.
-   Mandatory statutory rights for defective digital content, including remedies available under BGB §§ 327–327u, are not limited by this policy.
-   Using FSP AI speaking sessions, assessments, transcripts, or premium FSP guide features means digital access has begun and the plan is not eligible for a satisfaction-based refund.

**Pass Assurance Plans:** Pass Assurance plans provide access in 9-month renewable periods. Each renewal is a continuation of the original purchase and is not separately refundable. If you pass your exam during an active period, the remaining access time is not refundable.

**48-Hour Pass & Quick Prep (2-Week Pass) Notice:** The 48-Hour Pass and Quick Prep (2-Week Pass) are short-term, single-access digital products. By purchasing these passes, you expressly consent to immediate access and acknowledge that the **right of withdrawal is waived** once digital access begins, in accordance with § 356 Abs. 5 BGB (German Civil Code). This does not limit mandatory statutory rights for defective digital content.

## 3\. Pro-Rated and Partial Refunds

After the 14-day period, refunds are generally not available. However, we may consider partial refunds at our discretion in the following circumstances:

-   **Technical issues:** If you experience a persistent bug or technical problem that we are unable to resolve within 7 business days, you may be eligible for a pro-rated refund based on unused time
-   **Medical or emergency situations:** In exceptional circumstances (e.g., serious illness), we may offer partial refunds or subscription pauses on a case-by-case basis
-   **Duplicate payments:** Accidental double charges will be fully refunded immediately

## 4\. What Is NOT Eligible for Refund

-   Requests made after 14 days from purchase (except technical issues)
-   Users who have completed 2 or more exams (including free mock exams and practice modules)
-   FSP plan purchases once access to AI speaking sessions or premium FSP digital content has begun, except where mandatory statutory rights apply
-   Users who have used the platform for 45 or more minutes total
-   Users who have made 20 or more AI feature requests
-   Users who have downloaded premium PDFs or letter samples
-   Promotional or discounted purchases (unless stated otherwise)
-   Disagreement with AI feedback quality (see Section 6 below)
-   Failure to pass your actual exam (we provide practice, not guarantees)

## 5\. Service Availability and Maintenance

We strive for 99% platform uptime. However, technical maintenance or unexpected issues may occasionally cause temporary unavailability.

**Maintenance Policy:**

-   Scheduled maintenance is performed during low-traffic hours (typically 2:00–5:00 CET)
-   We notify users in advance of planned maintenance when possible
-   System downtime of **less than 12 hours in a calendar month** does not entitle users to refunds or price reductions
-   For extended outages exceeding 24 consecutive hours, we may offer service extensions at our discretion

## 6\. AI Content and Quality

Our platform uses AI to generate explanations, assess writing, and provide personalized feedback. Please note:

-   AI-generated content is provided for **practice purposes only**
-   Minor variations or nuances in AI feedback do not constitute a "defective product"
-   We continuously improve our AI models, but occasional imperfections are inherent to AI technology
-   Refunds based solely on "AI quality" are granted only at our discretion as a gesture of goodwill

## 7\. German Consumer Rights (Widerrufsrecht)

Under German law (§§ 312g, 355 BGB), consumers have a 14-day right of withdrawal for online purchases. However, for **digital content**, this right is waived once:

## 8\. How to Request a Refund
